Terms of Use

These Terms of Use (“Terms”) govern your use of the YachtRev website operated by Yachting Revolution, LLC, doing business as YachtRev (“YachtRev,” “we,” “us,” or “our”). By accessing or using the website, you agree to these Terms. If you do not agree, do not use the website.

Eligibility and authority

You must be at least 18 years old to submit a consultation request. If you use the website on behalf of a company, trust, family office, or other entity, you represent that you have authority to act for that entity and bind it to these Terms.

Informational purpose

Website content is provided for general informational purposes. It does not constitute legal, tax, financial, insurance, engineering, survey, safety, management, or other professional advice and should not replace advice from appropriately qualified specialists.

No advisory or brokerage engagement

Visiting the website, submitting a form, or communicating through the website does not by itself create an advisory, brokerage, fiduciary, agency, or other professional relationship. Any engagement, compensation, duties, and scope of representation are governed exclusively by a separate written agreement signed by the appropriate parties.

Private inquiries

Information submitted through a consultation or contact form is a private inquiry to YachtRev and is not public user content. You remain responsible for ensuring that your submission is lawful, accurate, and does not violate another person’s rights or confidentiality obligations. Please do not submit payment information, passwords, government identification numbers, account credentials, or other highly sensitive information through the website.

Yacht and market information

Yacht specifications, availability, pricing, market information, imagery, and third-party statements may change and may contain errors or omissions. They must be independently verified before any decision or transaction. Nothing on the website is an offer, guarantee, valuation, or representation that a particular yacht, builder, service, or outcome is suitable for you.

Acceptable use

  • Use lawfully. Do not use the website for unlawful, fraudulent, abusive, deceptive, or harmful activity.
  • Respect systems. Do not attempt unauthorized access, introduce malicious code, disrupt operation, evade security controls, or interfere with another user.
  • Respect content. Do not scrape, reproduce, republish, modify, or commercially exploit website content except as permitted by law or written permission.
  • Provide accurate details. Do not impersonate another person or submit knowingly false or misleading information through website forms.

Intellectual property

The YachtRev name, logos, website design, copy, graphics, and other original content are owned by or licensed to YachtRev and are protected by applicable intellectual-property laws. Third-party names and marks belong to their respective owners. No affiliation or endorsement is implied unless expressly stated.

The website may link to third-party websites or use third-party services. YachtRev does not control their content, availability, security, or practices and is not responsible for them. A link is provided for convenience and does not by itself constitute endorsement.

Website availability and suspension

We may modify, suspend, restrict, or discontinue any part of the website at any time. We may also block or suspend access when we reasonably believe a user has violated these Terms, threatened website security, or created legal or operational risk.

Disclaimers

To the fullest extent permitted by law, the website and its content are provided “as is” and “as available.” YachtRev disclaims warranties of uninterrupted availability, accuracy, completeness, merchantability, fitness for a particular purpose, title, and non-infringement. Rights and warranties that cannot lawfully be excluded remain unaffected.

Limitation of liability

To the fullest extent permitted by law, YachtRev and its members, managers, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, use, goodwill, or opportunities, arising from or related to the website.

To the fullest extent permitted by law, the aggregate liability of YachtRev and those parties for all claims arising from or related to the website will not exceed five hundred U.S. dollars (US $500). This limitation does not apply to liability that cannot lawfully be limited or excluded. Any signed brokerage or advisory agreement may contain different provisions governing services provided under that agreement.

Governing law and venue

These Terms and any dispute arising from or related to the website are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to any rights that cannot lawfully be waived, the state and federal courts located in Palm Beach County, Florida, will have exclusive jurisdiction and venue over such disputes, and you consent to the personal jurisdiction of those courts.

Changes to the website and Terms

We may update the website and these Terms. We will post revised Terms on this page and update the effective date. Your continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms, except where applicable law requires a different form of notice or consent.

Severability, waiver, and assignment

If any provision of these Terms is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce any provision is not a waiver. You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.

Complete agreement

These Terms and the Privacy Policy constitute the complete agreement between you and YachtRev concerning use of the website and supersede prior or contemporaneous communications about website use. They do not replace or modify any separately signed brokerage, advisory, confidentiality, or transaction agreement.
